The First Amendment and Art

Number of Pages 4

This essay presents a scenario in which the writer is presumed to be the major of a city who is confronted with a problematic situation. Protestors object to a work of art currently on exhibit at a publicly funded museum that they consider to be pornographic. However, the artist and the museum director defend this work and threaten to sue if the city pursues ordering them to remove the work. The writer cites First Amendment case law and argues that, as mayor, there is a constitutional right that protects the exhibition of the work. However, the writer also proposes a compromise position that considers these rights. Four pages in length, two sources are cited.
